A Nigerian lawyer, Stella, has disclosed that wives can be sued if they go through their husband’s phones without their consent.
According to the lawyer, this act can be described as an invasion of privacy, which is considered illegal and punishable under the law. She pointed out that this privacy breach can potentially lead to a civil lawsuit, even within the bounds of marriage.
The lawyer explained that for a husband to have a strong case, he would need to demonstrate in court that his wife accessed his phone with the intention to invade his privacy and that this action caused him tangible harm, such as emotional distress or damage to his reputation. This would be crucial in establishing that the breach was not only intentional but also harmful.
Stella also clarified that this legal framework applies to both spouses equally, meaning that a woman can also sue her husband for the same offense if he goes through her phone without permission. She emphasized that both partners have the right to protect their privacy, and infringing on that right could lead to legal consequences.
“Your HUSBAND can SUE you for going THROUGH his PHONE WITHOUT his CONSENT,” she wrote, underlining the seriousness of the matter. She further explained that accessing someone’s personal electronic devices without authorization could be legally viewed as INVASION of PRIVACY, a solid basis for a civil lawsuit, even in a marriage.
“ACCESSING someone’s PERSONAL ELECTRONIC devices without AUTHORIZATION can be considered as INVASION of PRIVACY,” she stated. “INVASION of PRIVACY is a LEGAL basis for a CIVIL LAWSUIT, even WITHIN a MARRIAGE.”
Stella stressed that for the husband to have a strong case, he must show that the wife accessed his phone with the specific intent to invade his privacy and that the invasion resulted in emotional or reputational harm. She concluded by reiterating that wives can also sue their husbands for similar offenses.
